Erica Menendez, 31, is being held in custody for the subway shove death of 46-year-old Sunando Sen. She is being charged with second-degree murder as a hate-related crime.

The death of 46-year-old Indian immigrant Sunando Sen is the second subway push death in New York City this month. Sen was killed on December 27, around 8 o’clock at night at the 40th Street-Lowery Street station in Sunnyside located in the Queens borough of New York City.

The authorities had identified the suspect as a heavyset Latino female in her 20s. After two days, a female suspect has been apprehended by the New York Police Department.

The female suspect in custody is 31-year-old Erica Menendez who made comments implicating herself in Sen’s death when questioned by detectives. As a result, Menendez has been taken into custody. She was questioned by detectives when someone spotted her on a street in Brooklyn after seeing the surveillance video on television.

Menendez is going to be charged with second-degree murder. However, due to talking about Muslims and 9/11 factored with the ethnicity of Sen, the second-degree murder charge also becomes a hate crime charge, resulting in a hate-related second-degree murder.

The victim, co-owned a printing business in Manhattan. Authorities were initially not able to identify Sen’s body because of the condition it was in. His body had to be recovered from underneath the second subway train car. Sen’s body was later identified through his phone and a medicine bottle.

He was single with no children and lived with roommates.

The first subway shove death in December, took place earlier in the month, in which 58-year-old Ki-Suk Han was pushed off the platform by Naeem Davis and to his death via the incoming subway train.

The investigation remains ongoing.

All charges are merely accusations and all defendants are presumed innocent until and unless proven guilty.
